The eBook User’s Bill of Rights

This is from Sarah Houghton-Jan and Andy Woodworth – take a peek (I’m guessing this will be all over the librarian parts of the web very soon).

They have crafted an eBook User’s Bill of Rights, and it’s good. Honestly, the only thing I’m not sure about here (and I might talk more about it later) is the right of first sale thing – that’s a hold-over from actually owning a physical object … and in the digital content world … well, you don’t actually own anything physical.

Otherwise, Sarah and Andy did a great job. in my mind, this Bill of Rights works for librarians AND authors – the idea of sharing and distribution is inherent in this document.

Does it work for publishers? I think it does. And it’s certainly a good place to start the conversation. What do you think?

The eBook User’s Bill of Rights is a statement of the basic freedoms that should be granted to all eBook users.

The eBook User’s Bill of Rights

Every eBook user should have the following rights:

  • the right to use eBooks under guidelines that favor access over proprietary limitations
  • the right to access eBooks on any technological platform, including the hardware and software the user chooses
  • the right to annotate, quote passages, print, and share eBook content within the spirit of fair use and copyright
  • the right of the first-sale doctrine extended to digital content, allowing the eBook owner the right to retain, archive, share, and re-sell purchased eBooks

I believe in the free market of information and ideas.

I believe that authors, writers, and publishers can flourish when their works are readily available on the widest range of media. I believe that authors, writers, and publishers can thrive when readers are given the maximum amount of freedom to access, annotate, and share with other readers, helping this content find new audiences and markets. I believe that eBook purchasers should enjoy the rights of the first-sale doctrine because eBooks are part of the greater cultural cornerstone of literacy, education, and information access.

Digital Rights Management (DRM), like a tariff, acts as a mechanism to inhibit this free exchange of ideas, literature, and information. Likewise, the current licensing arrangements mean that readers never possess ultimate control over their own personal reading material. These are not acceptable conditions for eBooks.

I am a reader. As a customer, I am entitled to be treated with respect and not as a potential criminal. As a consumer, I am entitled to make my own decisions about the eBooks that I buy or borrow.

I am concerned about the future of access to literature and information in eBooks. I ask readers, authors, publishers, retailers, librarians, software developers, and device manufacturers to support these eBook users’ rights.

These rights are yours. Now it is your turn to take a stand. To help spread the word, copy this entire post, add your own comments, remix it, and distribute it to others. Blog it, Tweet it (#ebookrights), Facebook it, email it, and post it on a telephone pole.

Questions that Need Answers

So, I’ve been reading the tweets, and talking to some people about the OverDrive/HarperCollins fiasco with ebooks – and it looks like there are quite a few questions that need to be answered. Here they are (please add the ones I’m missing):

  • HarperCollins: Why 26 checkouts/uses?
  • HarperCollins: Did you talk to libraries to come up worn that number? If so, which ones?
  • HarperCollins: Did you talk to any of your authors about this change? What did they say?
  • OverDrive: Why the secrecy in your letter? Why were you hiding HarperCollins’ name?
  • OverDrive: are there other publishers jumping at the bit to do this? If so, when will that hit?
  • OverDrive: Did you argue against this? Because you surely knew that libraries wouldn’t be fond of this idea.
  • OverDrive: My understanding is that this announcement went out as a PDF file to OverDrive partners. How come you didn’t publish this as a press release on your website? Again – shy the secrecy?

So – what other questions need answers here?

Let’s Play Rent-A-Book!

Imagine this, for a sec. What if a publisher … oh, heck – let’s just say HarperCollins … suddenly decided that yes, they were still going to let your library get books from them … but there was suddenly a catch. If too many library customers checked the book out, you’d need to pay more money! In essence, you’d need to actually pay for a single book … more than once.

“Well, David – that’s just silly talk” you might say.

Check this out – Overdrive sent out a Library Partner Update (link via the awesome Librarian by Day blog) to their “OverDrive Library Partners.” Here’s part of what it says:

“To provide you with the best options, we have been required to accept and accommodate new terms for eBook lending as established by certain publishers. Next week, OverDrive will communicate a licensing change from a publisher [update - it's HarperCollins, according to Library Journal]  that, while still operating under the one-copy/one-user model, will include a checkout limit for each eBook licensed. Under this publisher’s requirement, for every new eBook licensed, the library (and the OverDrive platform) will make the eBook available to one customer at a time until the total number of permitted checkouts is reached [according to Library Journal, it's 26 checkouts]. This eBook lending condition will be required of all eBook vendors or distributors offering this publisher’s titles for library lending (not just OverDrive).”

Then, from Library Journal – HarperCollins said this in a statement: “HarperCollins is committed to the library channel. We believe this change balances the value libraries get from our titles with the need to protect our authors and ensure a presence in public libraries and the communities they serve for years to come.”

So … HarperCollins is giving us a mere 26 checkouts per ebook … to protect its authors from … um … readers. Nice. Translation = we want more money.

But then, it gets even stranger. OverDrive continues:

“In addition, our publishing partners have expressed concerns regarding the card issuance policies and qualification of patrons who have access to OverDrive supplied digital content. Addressing these concerns will require OverDrive and our library partners to cooperate to honor geographic and territorial rights for digital book lending, as well as to review and audit policies regarding an eBook borrower’s relationship to the library (i.e. customer lives, works, attends school in service area, etc.). I can assure you OverDrive is not interested in managing or having any say in your library policies and issues. Select publisher terms and conditions require us to work toward their comfort that the library eBook lending is in compliance with publisher requirements on these topics.”

OK… So … you want to look at them, but not do anything with them? I’m missing something here, I think.

HarperCollins – what changed? We already have your print books in our libraries. To date, they have checked out WAY MORE than your ebooks (I’m sure this will eventually change, but still). But you have never attempted to do this silly rental thing with those books. Or asked us about our card issuance policies (which, for most of us, are readily available online – apparently a new concept for HarperCollins – assuming this was also a lovely HarperCollins initiative).

I get that OverDrive and individual publishers need to look to new funding models, or will need to eventually. But this? Well – it just seems weird to me.

Library Renewal is needed!

Have you heard about Library Renewal? It’s a new non-profit organization focused on making access to and distribution of electronic content much easier and accessible for libraries and library customers.

Sounds simple, huh?

I’m on the board of Library Renewal, and just posted my first blog post explaining why I’m a part of it – here’s that blog post!

Why am I involved in Library Renewal? Really, the question should be “how could I NOT be involved in Library Renewal?”

Because I think the biggest, most important battle in the library industry for this next decade isn’t social media, or what we do on our library websites – it’s how we access and distribute econtent to our patrons.

Our customers obviously want electronic content – the recent “after Christmas rush” of patrons wanting to download econtent actually spiked and slowed down the Overdrive ebook service! Yep – our patrons are ready for econtent and ebook readers.

But that’s only one place to go for content – what about all those easy-to-use consumer services out there like Netflix, or Amazon, or even Apple’s iTunes? Those are the places most people go to for econtent – they work great, they’re easy to use, and they’re relatively affordable.

… And they pretty much lock libraries out of the equation. That’s not good, and I want to help change that. And I think Library Renewal has the potential to be a major change agent in the whole econtent arena.

Ebook After Christmas Rush

Overdrive apparently experienced an “after Christmas rush” that has caused their service to temporarily slow down. Here’s what they say about it:

“In the last few days, you and your users may have experienced error messages or slow page loads when visiting your library’s ‘Virtual Branch.’ This temporary slowdown was due to an unprecedented spike in traffic on our library websites following Christmas. While we expected a surge in usage after the holiday, your customers’ interest in eBook and audiobook downloads was greater than anyone anticipated. Many of your websites saw usage double overnight, up from what were already record levels prior to Dec. 25.”

Wow. Ultimately, that’s a good thing – once Overdrive gets the service fully functional again, it means more users. Not a bad problem at all.

But it made me think:

  • have YOU experienced an after Christmas rush? Anyone visit your library with their new ebook reader yet?
  • and was your staff able to help them?

Two Pieces of Ebook Silliness

Just came across a couple of posts from The UK Publisher’s Association and from the CEO of Overdrive. Gotta say, it’s very interesting to watch and listen … but it’s a bit disappointing, too. Here’s a couple bits of what each of them said:

From Richard Mollet, Chief Executive, The Publishers Association, in his PA statement regarding our position on library e-lending post: “Ultimately, the activities of selling and lending have to be able to co-exist with neither unduly harming the other. If ebook lending were untrammelled (as some comments seem to propose) it would pose an extremely potent threat to the retail market which in the long-term would undermine the ability of authors, and the companies which invest in them, to see a reward for their creativity.  This would be hugely a negative outcome for everyone, including libraries and their communities.”

What? Did Mr. Mollet just say that if library patrons could download ebooks in an “untrammeled” way (which for them, I think means being able to check it out and download it from home), it would be a huge threat to the retail ebook market. Really? I’d love to see your numbers to back that up.

And how in the world would patrons checking out ebooks remotely “undermine the ability of authors … to see a reward for their creativity” ??? Come on.

Translation – We think ebook lending, if made too easy, will put us out of business. And, he very obviously doesn’t know how the whole checking out an ebook thing actually works (see below for a little more on that). Explains a lot, I think.

Next up: Steve Potash, CEO of OverDrive, with A statement on the Publishers Association’s position on eBook lending, writing in response to the silliness above: “OverDrive licenses eBooks under a “one-book, one-user” lending model … This model has successfully worked for years around the world, providing libraries with access to premium content while generating revenue for publishers.”

“Successfully worked” – if that means that libraries subscribe, then ok. But if it means our customers get it, then not so much. This statement sorta reminds me of the automotive industry CEOs, when they say “going to the gas pump is a time-honored tradition.” Hmm…

And I found this statement weird – maybe I’m not understanding it: “In 2009, visitors to OverDrive-powered library websites viewed more than 401 million pages. Among unique visitors to these download library pages, 80 percent did not check out a digital title, yet still visited 13 pages on average.”

Is he really saying that lots of people visited Overdrive’s service … but a whopping 80% didn’t check anything out??? Cause that’s what it sounds like to me. And if so … Well, that’s because Overdrive is SO VERY HARD TO USE.

Here’s an example from my library that happened last week. Topeka is currently participating in the Big Read, a grant-funded community-wide reading program. We picked The Maltese Falcon as our Big Read book – it’s available in paper and in a digital audiobook version from Overdrive. One of Topeka’s library customers (who happens to be the general manager of a local TV station) decided to checkout the digital audiobook version … on his Mac. After an hour of frustration on his part, he called the library for some help.

Were we able to help him? No, not really. For some reason, his web browser didn’t like the Overdrive website (he tried Google Chrome and Apple Safari). He wasn’t able to download the “unlimited use” version of the digital audiobook, because it was in the Microsoft Windows-based wma format. Although he could download the Mac-friendly mp3 format, it was checked out and therefore unavailable … which of course didn’t really make much sense to the patron.

Our library customer ended up frustrated at Overdrive, at the library (and told us so), and had a bad experience with our digital content.

Overdrive, Publisher’s Association guys, etc – you can do better than this.

iPads in Libraries – Some Stories

There are quite a few uses for an iPad in a library setting, and some libraries have already started experimenting. Here are two examples:

#1: Omaha Public Library

From Amy Mather – “For the past few years, the Omaha Public Library’s Summer Reading Program kick-off party has been held in Elmwood Park in Omaha and has attracted up to 2500 kids for kick-off activities including live music, games,  pony rides, etc. Although always a success, we had one glaring “missed opportunity” at these events: signing up kids & teens for the Summer Reading program “online” at an outside venue.”

“Gary Wasdin, director of Omaha Public Library, applied for a local grant to obtain 6 iPads in which we could use to signup kids & adults for the Summer Reading Program. The iPads would allow us to connect to the AT&T’s 3G network and signup patrons on the spot for the Summer Reading Program. On June 9th, we signed up over 500 kids, teens, and adults using iPads. The iPad allowed us to take the mobile library to the next level and we looked really cool too!”

#2: Genesee Valley Educational Partnership

From Christopher Harris – “I am at a school library system, a regional support center funded by NY state to provide services and resources for 22 small, rural school districts in Western NY. Since we got the iPads so late in the year, right now we are just loaning them to teachers and librarians to build awareness in our districts. Over the summer, we will be working on developing some best practice guidelines and suggested uses for the devices. We hope to begin lending them for student use in the fall, though they may be for in-school use only the first year as they remain a very high-value theft target. We have 150 iPod shuffles we send home with students without any problems, so hopefully we will get to that point soon with the iPads as well.”

“Right now, we are loaning books from iBooks. My reading of the terms of use suggest that we can do this within our system. I am also working directly with publishers to secure additional content. We have a number of graphic novel biographies from Rosen, as well as a large collection (125 sci-fi/fantasy books) that I just got from another publisher. As for other apps, we purchased Pages/Keynote/Numbers and have 5 keyboard docks we can send out. We also have Dragon Dictation, Sundry Notes, Complete Shakespeare, Historical Maps, and a few others.”

What are these two libraries doing?

  • fixing a problem (signing up kids online … in a park)
  • experimenting … but also developing guidelines and strategy for use
  • breaking out of the “this is the way we’ve always done it” syndrome
  • applying new technology to traditional library services

Library eBooks can be Frustrating!

Overdrive for iPhoneFirst – go read this – I am a frustrated eBook (non) user, by Sarah Houghton-Jan (you do read her blog, right? It rocks). Then come back, and let’s discuss.

I have to admit, I had a VERY similar experience with the iPhone Overdrive app. I spent a goodly chunk of time trying to figure it out, and gave up (planning to get back to it eventually). Instructions on use? There are some, but they didn’t make sense to me. I’m sure this one’s my fault, since I don’t usually listen to audiobooks … but still.

I was finally able to “successfully” check something out. But I guess it was already “checked out,” so I didn’t immediately get the book. Nope. I had to wait for 3 days, then received an email saying my download was ready. I was busy, so missed my window of opportunity to download the book… so now, I need to start over again!

My questions -

  • Why is Overdrive that hard to use? If Sarah and I can’t easily figure this thing out, our patrons won’t be able to, either. They’ll try once, then go use something else.
  • Thinking of my library here – normal books? Easy to check out. Videos in our Mediabank DVD dispenser? Easy as RedBox or an ATM machine to use. Overdrive? Hard enough to use that we set up a special PC right by our Reference desk so we can help patrons figure the thing out.
  • Check out the pic to the right – it’s the iPhone app. Help is prominently featured, front and center, right over the iPhone’s Home button) . At the least, that sends the wrong message. Why can’t there be something like “3 easy steps to downloading?” when you turn on the app for the first time, then have Help go under a secondary menu? If you really need Help on the main page, you probably need to redesign.
  • It’s a digital file – why can’t I access the ebook when someone else has it “checked out?” That doesn’t make much sense to me.
  • Why doesn’t the app have me make a connection to my local library the first time I use it? The process goes like this: download app, turn app on. Read Help. Click a link … that takes you out of the app, and onto the web. It would be much better to at least keep me in the app.

I know, I know – DRM. That’s the problem, right? I’m not completely buying that. At least SOME of the problem is on the design and usability end (of at least Overdrive). But there HAS to be an easier way to manage DRM concerns, like allowing someone to check out stuff, but then adding one extra step or something that makes you “prove” you’ve deleted the file? Netflix’s digital downloads and the movie rental part of iTunes are similar (except for that whole for-profit thing) to a library setup. They also deal with people “borrowing” their stuff, some of it even digitally. But it’s easy. Why can’t our library vendors (Overdrive, Netlibrary, etc) also build something easy to use and manage?

What’s a Real Book?

While I was at Computers in Libraries 2010, I listened to David Ferriero, the Archivist of the United States (he gave one of the keynotes at the conference). During his interview (Paul Holdengraber from New York Public Library interviewed him), he was talking about books and what he likes to read … and mentioned that he prefers print books over ebooks (he likes the aesthetics of paper books).

That’s fine – I get that.

But then, the audience … at Computers in Libraries … applauded! Like he’d just won an award or something. And soon after, someone tweeted “Yeah! David Ferriero still reads REAL books!”

Huh?

Help me out here – what’s the most important part of a book – the paper? Or the stuff on the paper? Anyone?

Do authors really think about paper when writing books (I know I didn’t when I wrote my book)? Most likely not. Instead, they’re thinking about the next twist in the story, or how to adequately describe that next thought.

Does anyone applaud when someone says “I still watch Super 8 movies?” How about if someone said “I still love reading print journals?” Nope. No applause there. No one would tweet “Yay! He still reads REAL journals!”

When I read something, here’s what I care about:

  • getting sucked into the story (with fiction)
  • learning something new or interesting (with non fiction)
  • being entertained and engaged (with both)

For me, this happens via paper, my iPhone, my computer, an audio book, an ebook reader, or online. I’m guessing you’re reading just fine right now.

So my point? I think it’s time for us librarians to get over our paper fetish.

Content and container – the two are really, truly, different. Books are stories or a largish chunk of non-fiction text – novels, biographies, histories, etc. The format or container? This tends to change (though it hasn’t in a long time).

Don’t get me wrong. I’m not saying books are bad. I’m also not saying print is bad. But I am saying that when lots of people applaud someone … at a conference dedicated to computers and the web … for favoring one container over another, it shows our bias, it shows our professional bent … and that bent needs to be adapting and growing and watching the horizon.

Do you need containers for information? It’s a real question…

What does Open mean?

- there’s line-ups in front of a movie theater? Because they’re engaged
- why do you read? entertainment, relaxation, be successful, learn info, etc
- open source, open infrastructure, open bar, open standards, etc…

Does Open require a container? It shouldn’t

What does Social change?

Think about it.

We all work in social institutions, we work in a transaction-based organization. Counting transactions, clicks, etc – we don’t actually know what they did.

Suddenly, the software and the activity aligns.

How does your library deal with visual material? For visual learners?

Ex – do you want your surgeon to have reviewed videos of successful operations, or do you want them saying “don’t worry – I read an article” ??

What’s driving the need for Open?
- user expectation
- architecture
- the cloud
- APIs
- social media
- experience trends
- personalization

The API cloud … lots of API possibilities…

“You shouldn’t have to dust something that people want…”

What about Apps?
plugins, itunes, etc. first app is usually facebook – for connecting with actual people.

What’s your experience look like?

University experience – what’s it look like? We used to shove people in carrels now we create more meeting and interaction spaces.

Old Containers -
- these are not going away!
- but they are always physical
- physical formats are losing market and mind share
- especially in the discovery and learning space

Traditional experiences:
- school, continuing education – how is it changing?
- open library hours – in the academic world, there’s a second peak between 10pm and 2am – anyone staff for that? Similar to a public library and people getting home from work and school …

New Containers:
- mostly virtual
- ecourses, lessons, websites, portals, sessions, events, digital photo albums, etc
- how do these objects fit into a positive transformational experience?
- we shouldn’t be measuring only transactional clicks.

Measure did the user find what they wanted, and did they enjoy the experience?

types of containers, revised: paragraphs, chapters, clips, graphics, pictures, etc.

Container success – focus not he end user in context. Where are they? In the shower? Driving? Sitting at a desk? Etc.

Content is not enough

focus on the results of the experience

support readers, not authors. learners, not teachers. collectors, not collections. etc.

design for use, not clicks.

Try writing a game that has only three clicks. They engage because there is something happening that engages them every step of the way. The get a coin, get a clue, find a monster, etc.

design for transformations, not transactions.

design for learning styles.
